Terms & Conditions

1. DEFINITIONS

1.1 “Platform” means the HeimaTorg website and related digital interfaces operated by HeimaTorg ehf.
1.2 “User” means any individual or legal entity accessing or using the Platform.
1.3 “Requesting User” means a User who submits a service request through HeimaTorg’s request form or via email.
1.4 “Service Provider” means an independent professional or business offering services and cooperating with HeimaTorg to receive Leads.
1.5 “Request” means information submitted by a Requesting User describing a need for a specific service.
1.6 “Lead” means contact and request information that HeimaTorg chooses to share with one or more Service Providers.
1.7 “Lead Fee” means a fixed, one-time fee charged by HeimaTorg to a Service Provider for access to a Lead.
 

2. ROLE OF HEIMATORG

2.1 HeimaTorg operates as a lead-generation and matching service only.
2.2 HeimaTorg:

  • does not provide services,

  • does not employ Service Providers,

  • does not act as an agent, broker, or representative of any User.

2.3 HeimaTorg collects Requests from Requesting Users and internally evaluates and matches suitable Service Providers based on availability, category, or other internal criteria.

2.4 Requests submitted by Requesting Users are not publicly visible and are accessible only to HeimaTorg.
 

3. ACCEPTANCE OF TERMS

3.1 By using the Platform, Users confirm acceptance of these Terms.
3.2 Users who do not agree must refrain from using the Platform.
 

4. REQUESTING USERS

4.1 Submitting a Request through HeimaTorg is free of charge.
4.2 By submitting a Request, the Requesting User confirms that:

  • the information provided is accurate and truthful,

  • they genuinely seek the requested service,

  • they consent to being contacted by one or more Service Providers.

4.3 HeimaTorg does not guarantee that:

  • a Service Provider will be assigned,

  • a Service Provider will respond,

  • a service will be performed.
     

5. SERVICE PROVIDERS

5.1 Service Providers cooperate with HeimaTorg on a non-exclusive and independent basis.
5.2 HeimaTorg may, at its sole discretion, share Leads with selected Service Providers.
5.3 Access to a Lead is subject to payment of a Lead Fee, agreed outside the Platform.

5.4 Payment of a Lead Fee:

  • is one-time per Lead,

  • is non-refundable,

  • does not guarantee conversion, agreement, or payment from the Requesting User.
     

6. NO PAYMENTS OR CONTRACTS ON THE PLATFORM

6.1 HeimaTorg does not:

  • process payments,

  • collect fees from Requesting Users,

  • handle service pricing,

  • manage or enforce contracts.

6.2 Any agreement, payment, invoice, or dispute arises solely between the Service Provider and the Requesting User.
 

7. NO GUARANTEE OF TRANSACTION

7.1 HeimaTorg does not guarantee that:

  • contact will result in a job,

  • a Service Agreement will be formed,

  • services will be completed,

  • payment will be made.

7.2 Service Providers accept all commercial risk related to Leads.
 

8. INDEPENDENT STATUS

8.1 Service Providers operate as independent businesses or contractors.
8.2 Nothing in these Terms creates:

  • employment,

  • agency,

  • partnership,

  • franchise,

  • or joint venture relationships.
     

9. DISCLAIMERS

9.1 HeimaTorg does not verify:

  • qualifications,

  • licenses,

  • insurance,

  • or performance of Service Providers.

9.2 HeimaTorg does not guarantee the accuracy, completeness, or reliability of Requests.

9.3 The Platform is provided “as is” and “as available.”
 

10. LIMITATION OF LIABILITY

10.1 To the maximum extent permitted by law, HeimaTorg shall not be liable for:

  • loss of income or profit,

  • failed conversions,

  • service quality,

  • disputes between Users,

  • damages arising from Service Agreements.
     

11. DISPUTES BETWEEN USERS

11.1 Any disputes between Requesting Users and Service Providers must be resolved directly between them.
11.2 HeimaTorg has no obligation to intervene, mediate, or arbitrate.
 

12. TERMINATION

12.1 HeimaTorg may suspend or terminate access to the Platform for misuse, fraud, or breach of these Terms.
12.2 Termination does not affect outstanding Lead Fees agreed outside the Platform.
 

13. DATA PROTECTION

13.1 Users consent to the processing and sharing of personal data necessary for lead matching.
13.2 Personal data is processed in accordance with applicable data protection laws, including GDPR.
13.3 Users may request access, correction, or deletion of personal data.
 

14. COMMUNICATION

14.1 Users consent to being contacted by HeimaTorg for:

  • lead handling,

  • operational purposes,

  • service updates,

  • compliance and support.
     

15. CHANGES TO TERMS

15.1 HeimaTorg may amend these Terms at any time.
15.2 Continued use of the Platform constitutes acceptance of updated Terms.
 

16. GOVERNING LAW AND JURISDICTION

16.1 These Terms are governed by Icelandic law.
16.2 Any dispute between HeimaTorg and a User shall be subject to the District Court of Reykjavík as the court of first instance.
